Terms of Use
1. Acceptance of Terms
By accessing, browsing, or using the FixMyFault™ website (the "Platform"), operated by FIXMYFAULT™ (trading as FixMyFault™), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use our services.
2. Nature of the Service
FixMyFault™ acts exclusively as a marketplace and Lead Generation intermediary connecting homeowners ("Customers") with local, independent tradespeople ("Trades").
- No Employment Relationship: We do not employ, contract, or manage the Trades listed on our platform. They are independent contractors operating their own businesses.
- No Contract of Work: Any agreement, quote, or contract for physical labour, repairs, or materials is strictly and exclusively between the Customer and the Trade. FixMyFault™ is not a party to this agreement.
3. Limitation of Liability
To the maximum extent permitted by UK law:
- FixMyFault™ assumes no responsibility or liability for the quality, safety, legality, or outcome of any work performed by a Trade introduced through the platform.
- We are not liable for any disputes, damages to property, or financial losses occurring as a result of a booking made via the Platform.
- While we manually verify public liability insurance and identification upon a Trade's registration, we do not guarantee that the insurance remains active at the exact time a job is performed. Customers are advised to request proof of current insurance directly from the Trade prior to work commencing.
4. Trade Subscriptions & Micro-Fees
Trades using FixMyFault™ agree to the financial terms governed by our Pricing tier. All subscription fees (£15 or £30 per month) are processed securely via Stripe and are non-refundable.
Micro-Fees: In addition to the monthly subscription, Trades are subject to a micro-fee (£3 for standard jobs, £5 for emergency jobs) strictly generated at the exact moment a Customer clicks "Book this Trade". This fee is charged automatically to the card on file. Trades acknowledge that they must maintain a valid payment method on file to continue receiving AlertVector™ leads.
5. Account Deletion & GDPR Rights
We respect your right to control your personal data. In accordance with UK GDPR:
- Voluntary Deletion: You may permanently delete your account and all associated personal data at any time via the Settings > Privacy & Data panel. This action is irreversible.
- Regulatory Retention: While we fulfill deletion requests promptly, we are legally required to retain certain data (e.g., invoices, transaction logs, and security audit trails) for a period of up to 6 years for tax and regulatory purposes.
- Platform Suspension: FixMyFault™ reserves the right to suspend or ban any account that violates these Terms. In such cases, your right to data portability (SAR) remains active, but access to marketplace services will be terminated.
6. Intellectual Property
The FixMyFault™ name, logo, AlertVector™ engine, source code, and custom graphics are the exclusive intellectual property of FixMyFault™. You may not copy, reverse engineer, or scrape data from our Platform without express written consent.
